So its actually illegal to just post a picture even If i am in a way advertising their cage for them?! Wow thats strange. I could understand stealing pics of other peoples rats, but of a cage??

Without their permission, yes.

It's their property, they took the picture and it "belongs" to them. They might have posted it somewhere on the internet, as I have done with much of my photography, but just because you found it on Google images doesn't mean it's up for grabs.
 
I'm sorry to hear about what your adopter did. Since they were not breed on purpose and you are doing the responsible thing make sure you post them on here for people to potentially adopt :)
 
Yes I was going to see if anyone wanted some, I'd love it for someone from one of these forums to have a few. They will be loved and spoiled. I will keep you updated when I have them back here and I know more.

I still need to edit the site, my internet is seldom working.

Sorry about that Jo, they were not posted on here but over on ratforum. From what I understand someone who adopted two of her females, breed them to their male and said it was an "accident". Due to her adoption contract saying no breeding she took the females and babies back from them and will need to find homes for all the babies. Ema can fill in the rest when she sees this.
 
Hi yes two of the females I had adopted out were found to be pregnant when I went to check they were settling in. I spoke to the girl who signed the adoption agreement Lexi and she said 'it was her younger brother who left the cage doors open' and that yes she would drop them off the following day. The next day she didnt turn up so I called her and she said she had experience and wanted to raise the babies herself. Of course I said no, and she hung up. I was unable to get a hold of her for 24 hours, but I left tons of messages. Finally her mom spoke to me and said the girl was a minor and that makes the contracts void so they are keeping the babies?!?!? The girl obviously told the mom the rats were more like a year old the mom thinks we are lying about their birth date and that we adopted them out already pregnant. Our adoption agreement is dated, they were adopted out at 5 weeks on the dot. But I cannot get thru to her.

The girl drove to our house and showed us two peices of ID, plus she looked old enough. She answered all our questions, knew all about their care..... Im going to our police department tomorrow to see what can be done. Our SPCA said they cant do nothing unless its a spca rat.

So Im not even sure If I will be able to get them back and get them the appropriate care they need. If im not online much recently you know why.....
 
For reference of others that might be reading and have a similar issue or concern, I'm reposting my response:

Contacting the police likely won't help. This is outside of their expertise, interest, or concern. I'm sure there are bigger, worse things they are concerned about.

Your better bet is to contact a lawyer. Most lawyers are able to offer marginal legal advice for free, or lower cost. If the lawyer thinks you have a case, you will probably be advised to go to small claims court.

Whether or not you have a case and how to file that case, depends at least partially on your area, the laws, the attitude, etc. Around here, people have sued for less, but there's a very different attitude than many other places. If you do go to court, there is no guarantee you will win, but that would be your best option to get your babies back. There is no other way to force these people to give up the rats they currently legally own. Before you do anything with court, contact a lawyer.

Thanks for posting the info, I've been so worked up about the issue. Also Im sorry if any of my other posts have offended you, I have to rain in my head strong ways. I really have no issues with you, and I think you are a very talented passionate breeder. My comments really dont mean to sound how they come out, Im terrible at wording things. I forgot my main reason for joining these forums... to give my rats the best possible care - so Im not here to make enemies. Apologies for any spelling mistakes too... I used to be quite literate.

My dad has been in the police for 20 years and there's all different forces obviously, and about the most serious they get it a neighbour with a biting dog or someone playing their music too loud. That's the majority of their calls.... minor.

But they might just dismiss it as just a rat.

Things must be different here. The essential issue is a contract violation. Where I live, if you call the police about a contract violation, they will tell you to talk to a lawyer.
 
Wow , thats a horrible situation... I really hope you get your girl and babies back... but if the girl really is a minor , you may have a hard time unless you made photo copies of the ID's she showed you.
 
I just meant maybe they can tell her the proper way to get her property back. I know after you get a court order you can sometimes get a police escort to come with you to get your actual property.
 
I spoke to lawyer today in town, and whilst I may have a case it wont actually go before the jury for over 6 months - by this time the babies will have grown up and end up god knows where so it would be fruitless!!! He said I may be able to sue them for loss of property and get about $150 but my court fees would be more than this. He said I'd have a better chance calling the cops and claiming the girls stole them from us?!?! ... Must of been a crook lawyer.

I have sent some emails to the girl trying to talk to her and explain the medical care they need. Ive told her Im here if she needs help.... what more can I do.

I have her address... should I go physically get them myself.. no wait, that would be stupid of me. I'll not quit trying though, maybe they will come to their senses.
 
Have you told them that you've contacted a lawyer and will be processing them if they refuse to return them? Sometimes just the threat of it might make them realize that legalities are a real possibility for them. You can also sue them for your court fees and for your time as in loss of income from work. You could also call the police and ask them if it's possible to have an officer escort you to the home in order to retrieve your property for breach of contract.
